the overwhelming influx. i'd shut down the border immediately. it is hurting people. [applause] the drugs are pouring into the country. eric: detaining more than 60,000 migrants just in the last week. you are looking live at brownsville, texas, 11:04 a.m. central time of one of the camps where migrants in brownsville are waiting. even though they have detained many, the border patrol says 16,000 got away. the surge of migrants after title 42 ended last week. take a look at that. there is your answer. live in el paso texas. what type of numbers?

>> well, eric, so many numbers tossed around it is hard to keep track of them all. the latest numbers this morning, this past week it released 4297 migrants into the street here. that is the highest number of any calendar week so far this year. sources tell fox news that we saw an all-time high 10,000 plus migrants per day. the highest for each individual day. that happened before title 42 expired on thursday. now in the past 24 hours however, migrant encounters in the rio grande sector alone, the

chief there the chief tweeted they had 3000 encounters on monday alone. the number plummeted to 468. what could we credit to this drop we saw texas dps agents physically standing in the way of migrants at the rio grande river. also perhaps cooperation from mexico. allowing migrants to be paroled. >> the united states border patrol has experienced a 50% drop in the number of encounters versus what we were experiencing earlier in the week before title 42 ended at midnight on thursday. it is still early. we are in day three. >> you know, we show from the images of migrants crossing, large groups crossing into the united states. what happens to them after they

get into the u.s.? right now here in the streets of downtown el paso, they are migrants who are been sleeping on the streets, scattered across two or three video blocks. now they are charity groups or church organizations that show up during the day and feed them. looks like they may be setting up for sunday church service here as well. i commuted earlier with a translator. coming from colombia and venezuela. they want to get to various cities including new york, orlando. they were all processed and released. one of them showed me their parole paperwork. i cannot confirm whether they are here legally or not. they say they want to work for food the migrants we were speaking to. i want to get jobs in the united states. this is just the first offer these migrants and then they plan on relocating or somehow getting to various locations across the united states. eric.

eric: court date appearances. we are hearing 2027, 2035, a court date a decade from now. what are the chances of someone showing up for that? >> sure. i had been monitoring your tracking one migrant from texas. his court date was about two years after he arrived into the united states. he wants to get his working papers. i am told by border patrol if they do not show up for that court date, they will be immediately expelled from this country. if they ever encounter law enforcement moving forward, they have no chance. they will be deported. legally staying here working and getting the legal papers they will stay up for the court date. if not, then they probably won't eric: they say many do not show up, of course. we see how that works. thank you. arthel. arthel: thank you. a group of veterans, some

suffering from ptsd may now be victims of new york migrant bussing battle. twenty homeless vets just got kicked out of several hotels in the suburbs north of manhattan to make rooms for those migrants getting busted from the city. >> new york city's rush to find new shelters has it displacing group of people. as you mentioned, veterans. located in the suburbs telling fox news in part, our veterans were housed in several hotels that were preparing to receive migrants from new york city. thankfully, my team and i were able to scramble to buy new temporary housing for these veterans. whether you agree or disagree with migrants being housed in the hudson valley, i believe all of us can agree that this issue should not negatively impact our homeless veterans who have sacrificed so much for our

country. on thursday, new york city mayor sent to adult buses filled with migrants, 60 in total, to the suburban orange county. the city says that it is paying for them to have a hotel stay of up to four months. adams also had planned to send migrants to rockland county. a supreme court judge issued a temporary restraining order block in the city's milk. the city is reviewing its legal options. for now, -- it leaders are speaking out about the veterans getting the boot. >> in the last couple of days since i've spoken to you, brides and grooms and their wedding parties have been kicked out of their hotel in place for these migrants in new york city. fifteen veterans were kicked out. combat veterans that were homeless. a slew of other people. >> that orange county leader you

that was a touching tribute to the four university of idaho students who were brutally murdered six months ago. their school award in the mall posthumous degrees at the ceremonies. the suspect remains behind bars awaiting a preliminary heating next month on the four counts of murder he faces. jeff paul following the very latest on this story. he joins us live.

it is bittersweet as they not only remember the students that were killed but honor them. madison, kaylee, both seniors when they were murdered. the university providing certificates to the families. during the ceremony, kaylee's family walked across the stage. they received a bachelor's degree in general studies on her behalf. madison's parents were also at the university on saturday for the graduation ceremonies. they, too, walked onto the stage to accept her posthumous bachelors degree in marketing. >> they will always be members. thank you for joining us today to celebrate her academic achievements and contributions to the university of idaho. >> the four students were

that the prosecution has in order to convict him of a particular crime. if you charge murder you have to prove intent. i don't know if the prosecution or anyone is able to show he intended to kill,. that is the biggest obstacle. a matter or not it was reckless or perhaps the chokehold was too long in the second element there is an actually cause a person's death. the reckless behavior caused a person's death. >> protecting himself, protecting the people in the car would that wash over and make -- what a jury look at that and say, look, he tried to subdue him and it went too far, tragically. >> there is a number of defenses when he did not do it, clearly,

we know he did it. accident. we are beyond accident here. certainly, the behavior of, the erratic behavior, the criminal convictions could come into place, the condition so that, whether they were passengers that felt threatened, eyewitnesses will be key to the defense on this. whether or not they felt threatened that neely would attack them. he jumped in. >> you are saying in this case, his defense can bring up neely's arrest record, arrested about 40 times. hitting another subway rider in the face, breaking an eye socket and her nose. the jury could hear neely's criminal history?

>> they could hear criminal history based on bad prior acts. mainly convictions. yes, there is a possibility that criminal record will come out. if i'm the defense attorney for penny, i will bring that up. the prosecution will try to keep that out because they want to make this a case about the reckless behavior regardless. whatever neely had going on, pennies reactions were reckless. i think that this will go to trial. this will go to a jury. there is a lot at play. this will just go out to a jury, for sure. a lot of narratives that play. black versus white, conservative versus liberal. high crime in the city subway speared a lot of narratives going in. it really boils down to was penny acting on behalf of others and whether a jury will that in order for him to be acquitted.

he got arrested so let's peel that narrative. it really boils down to a mental health issue. what the city is doing to keep people out of the subway that have mental health. this could have been prevented. politicians that make statements about race, it is just not responsible. this has nothing to do with race and everything to do about mental health. >> what is so shocking and insulting to the taxpayers of new york and the citizens of new york city, she wants to ensure that new yorkers have access, they have to make the budget investments. this city spends millions of dollars of year on this. one of the most critical with mental health issues. the system is failing the

industrial complex homeless mental health industrial complex is failing. those that need help the most. tragically, the end result is what you saw with neely. this whole system, it you see these tragic incidents happen. the mac throwing stones at a glass house here. seeing if there is more to be done to prevent the death. there was a civil liability here as well. they can sue for a wrongful death here. there will be something that we can watch for some time here. as a new yorker, we have got to stop and take account of what we are doing with mental illness and crime in the city.

alabama teenager and a robot. jordan van der sloot now awaits extradition to the u.s. his lawyer says he does not trust the american judicial system. his clients extradition was approved without any hearing. he also fears prosecutors may add more charges including murder to his wire fraud and extortion case. joining us now, ted williams. former d.c. homicide detective. he has covered the holloway case from the very beginning. if i could get your reaction to jordan van der sloot attorney, and if you would walk us through the legal and processing steps once he arrives in the u.s. >> let me say happy mother's day to all of the mothers out there. i can tell you that the attorney is clearly wrong. there is a 2001 treaty between

peru and the united states that allow for this kind of extradition. i think that they are utilizing the extradition treaty to extradite jordan van der sloot from peru to the united states. >> okay. what do you think about what his attorney said that he does not trust the system here? >> i think that it is hogwash. we need not trust the word of vander sloop. taking you back to may 2005. natalie holloway was on a trip to aruba. she was seen leaving a club there with a guy named jordan van der sloot as well as two other individuals. those individuals after she went

missing were arrested. remaining in jail for a certain amount of time. it was in 2010 that beth and dave holloway put out a an award of $250,000. jordan van der sloot heard about the reward. he would tell them where their daughter was buried. he also mention the fact that his father was involved in helping barry natalie holloway. they gave him $21,000. but he lied. there was nobody. unfortunately, we have not found the remains of ms. holloway. waiting 18 years for this day to

come. eighteen years is a long time for potential witness memories to fade. circumstantial evidence is lost. is that why currently there is not a murder charge? natalie holloway, they have not been in a direct matter to show that jordan van der sloot who was in jail in peru for a murder of a peruvian that he was conne. that is a reason why they have not charged him with murder. highly unlikely they will charge him with murder when he gets here to the united states. they will charge him with extortion and wire fraud. >> as you well know, like currently he is serving 28 years

for different murder conviction. when may he serve time in a u.s. prison for extorting the $25,000 from the holloway family? is it possible he could serve time here in the states and how much time could he face? >> as you said, 28 years in peru. peru has agreed to temporarily extradite him to alabama here. that is certainly up in the air because while they are temporarily extraditing him to alabama, they will want him to come back to peru to serve that sentence. this is all being worked out with the united states government and peru at this time, arthel. arthel: you are saying after he serves that 28 year sentence

they are and peru he would come back to the u.s., perhaps and serve even more time? >> that could very well have been. if he came back to the united states after serving, they would put them on trial for the extortion and wire fraud charges they may very well have other charges that they may want to bring against jordan van der sloot. normally when you extradite somebody, you extradite them to that country and they remain in that country. this temporary extradition from what we have been told back in peru to serve the sentence for the murder of someone in peru. >> all kinds of legal leads and crazy stuff in this case. i appreciate you breaking it down for us in keeping me on this and making sure i have all
